Apartment handover - legal acts (handover of the apartment from the developer)

 

Today about the first guideline, which is the basis for pointing out defects in the apartment, the removal of which will be the developer's obligation. This refers to the one mentioned in the previous post from the series #krb_handovers - POLISH LAW.
The main documents here are laws and regulations. The most important of them in our case are:

 

Announcement of the Minister of Development and Technology of April 15, 2022, regarding the announcement of the consolidated text of the regulation of the Minister of Infrastructure on the technical conditions that buildings and their location should meet (Handover of the apartment from the developer)

 

It contains many principles, parameters, and values that we can refer to during the handover.

 

Act of May 20, 2021, on the protection of the rights of the buyer of a residential unit or single-family house and the Developer's Guarantee Fund (Handover of the apartment from the developer)

 

It is the basis for demanding the removal of defects by the developer within a specified time.

 

Announcement of the Minister of Development and Technology of July 12, 2022, regarding the announcement of the consolidated text of the regulation of the Minister of Development on the detailed scope and form of the construction project (Handover of the apartment from the developer)

 

It clearly states which standard we should rely on when calculating the area.

There are also two laws that I will reference in later posts, but from the perspective of an "apartment receiver," they are less important, so I just want you to know that they are:
 
- Act of July 7, 1994 – Construction Law
 
- Act of September 12, 2002, on normalization.
